Overstaying a visa in Vietnam: fines and what to do

Gateway Visa · Updated 13 Oct 2026 · 4 min read

A busy street in Ho Chi Minh City

Overstaying by even one day is an administrative violation. Fines rise with the number of days, and past a certain point deportation becomes possible. Here is what to do as soon as you notice.

What counts as overstaying

You have overstayed when you remain in Vietnam after the permitted stay shown on your entry stamp, visa or residence card. Many people confuse visa validity with permitted stay, especially when they enter visa-free.

Current fines

Under rules in force since late 2025, fines rise with the length of the overstay: from VND 500,000 to 2 million for under 16 days, up to VND 30 to 40 million for one year or more. From 16 days, deportation can also be applied. The exact amount is decided case by case by the handling authority.

What to do straight away

  • Do not simply go to the airport without knowing how your case will be handled, especially after a long overstay.
  • Gather your passport, residence papers and the reason for the overstay (illness, a cancelled flight) with supporting documents.
  • Contact the immigration authority or a service provider for guidance on paying the fine and completing exit procedures.
  • Pay the fine and keep the receipt.

Later consequences

The violation is recorded in your immigration history and can affect later visa, work permit or residence card applications. A long overstay can lead to an entry ban for a period.

How to avoid it

  • Note your permitted stay date as soon as you enter.
  • Start an extension or a new application at least two weeks before that date.
  • Recheck your residence document dates whenever you change passport or employer.
